Respondents may file their counter affidavit within a period of six weeks. Two weeks' time, thereafter, shall be available to the learned counsel appearing for the petitioner to file rejoinder affidavit.
List after expiry of the aforesaid period.
As regards grant of interim relief, it has been contended by learned counsel appearing for the petitioners that in terms of the provisions contained in Government Order dated 20th April, 1995, and the amendments made in Regulation 15 of Chapter I of the Regulations framed under the U.P. Intermediate Education Act, 1921, the petitioners are entitled to continue to work till 31st March, 2016.
The date of birth of the petitioner no.1 is 9th June, 1955 and of petitioner no. 2 is 5th May, 1955 who are to attain the age of superannuation in the month of June, 2015 on their attaining the age of 62 years. If the amendment in the aforesaid Regulation framed under U.P. Intermediate Education Act, 1921 by notification dated 15th October, 2014 was not brought into force, the petitioners would have ordinarily retired on 30th June, 2015. Since now the academic session has been re-defined to mean that the same would end on 31st March every year and again start from 1st April, the retirement of the petitioners on 2nd June, 2015 will fall in the mid of session and therefore, if the provisions contained in the notification dated 15th October, 2014 are read in consonance with the Government Order dated 20th April, 1995, the petitioners shall be entitled to work continue till 31st March, 2016.
Thus, the petitioners have been able to make out a case for grant of interim relief. Accordingly, as an interim measure it is provided that the petitioners shall be permitted to continue to work and discharge their functions on the post till 31st March, 2016 and they shall also be paid salary as and when the same accrues. However, the continuance of the petitioners and payment of salary shall abide the final decision of this petition.

माध्यमिक शिक्षकों के सत्रलाभ पर लखनऊ बेंच का फैसला
बेसिक के भी हजारो शिक्षकों को भी मिल सकता है सत्रलाभ
बेसिक शिक्षकों की याचिका पर भी होना है सुनवाई
30 जून 2015 को रिटायर हो रहे शिक्षक अब 31 मार्च 2016 को रिटायर होंगे। हाईकोर्ट की लखनऊ खंडपीठ के न्यायाधीश ऋतुराज अवस्थी ने याचिका संख्या 912/ 2015 का निस्तातरण करते हुए यह आदेश दिया है। उप्र माध्यमिक शिक्षक संघ के महामंत्री हरिश्चंद्र दीक्षित ने बताया कि न्यायाधीश ने 18 मार्च 2015 को यह आदेश दिया है, जिसमें 20 अप्रैल 1995 के शासनादेश को आधार बनाकर कहा गया है कि जब सत्र 30 जून को समाप्त निर्धारित था। तब शिक्षकों का रिटायरमेंट सत्र समाप्ति 30 जून के साथ होता लेकिन नई व्यवस्था के तहत 15 अक्तूबर 2014 को सत्र का अंतिम कार्य दिवस 31 मार्च निर्धारित कर दिया गया। इसलिए अब माध्यमिक शिक्षक 31 मार्च को सेवानिवृत्त होना चाहिए। याची को 31 मार्च तक कार्य करने की अनुमति प्रदान की गई है। इससे 30 जून को रिटायर हो रहे हजारों शिक्षकों को फायदा मिलेगा।

Learned counsel for petitioner submits that in view of the Government Order dated 15th October, 2014 academic session is to commence from 1st April and will end on 31st March every year. Vide Government Order dated 20th April, 1995, it was provided that the Teachers shall not be retired during mid academic session and shall be allowed to continue till the end of academic session i.e. 30th June.
Submission is that in view of change in the date of commencement and date of end of academic session, the petitioner shall be allowed to continue till 30th April, 2016.
Let counter affidavit be filed by the respondents within four weeks. Rejoinder affidavit, if any, may be filed within two weeks thereafter.
