Notice on behalf of opposite parties no. 1,3 and 5 has been accepted by learned Chief Standing Counsel and Shri J.B.S. Rathour, learned counsel put in appearance on behalf of opposite parties no. 2 and 4. 

By means of present writ petition, the petitioners are seeking a writ in the nature of mandamus for commanding the opposite parties to prepare the list of posting place according to the counseling, ignoring the order dated 17.10.2013, by which the petitioners were posted on the basis of roster. 

Submission of learned counsel for the petitioners is that petitioners feeling aggrieved against the action of District Basic Education Officer, Sultanpur of making inter district transfer on the basis of roster, approached before the Secretary, Basic Shiksha Parishad, U.P., Allahabad, but no action was taken on the same, therefore, the petitioners are constrained to approach this Court by means of present writ petition. 

Learned counsel for the petitioners after arguing at some length confines his prayer only to the extent that Secretary, Basic Shiksha Parishad, U.P., Allahabad may be directed to consider and decide the representation of the petitioner dated 17.10.2013 (Annexure No. 7 to the writ petition) within time frame fixed by this Court.

 

Learned� counsel for opposite parties have no objection to the prayer of learned counsel for the petitioners. 

Taking into consideration the innocuous prayer of learned counsel for the petitioners, the present writ petition is disposed of with a liberty to the petitioners to raise their grievance before the Secretary, Basic Shiksha Parishad, U.P., Allahabad� by making fresh representation� within 15 days from today along with certified copy of this order.� If any representation is made within the aforesaid period, the same shall be considered and decided by the Secretary, Basic Shiksha Parishad, U.P., Allahabad in accordance with law within one month thereafter.
