सरकारी कार्यालयों में शिक्षणेत्तर कार्यो के लिए संबद्ध नहीं होंगे प्राथमिक शिक्षक, जनहित याचिका की सुनवाई के दौरान राज्य सरकार के अधिवक्ता ने दी जानकारी, कोर्ट ने मांगा हलफनामा।

 प्रयागराज : प्राथमिक और उच्च प्राथमिक विद्यालयों के अध्यापकों को सरकारी कार्यालयों में शिक्षणोतर कार्यो के लिए संबद्ध (अटैच) नहीं किया जाएगा। एक जनहित याचिका की सुनवाई के दौरान राज्य सरकार के अधिवक्ता ने हाईकोर्ट में यह जानकारी दी।

सरकार की ओर से बताया गया कि इस आशय के आदेश जारी कर दिए गए हैं और सभी अध्यापकों की संबद्धता समाप्त कर उनको स्कूलों में भेजा जा रहा है। कोर्ट ने प्रदेश सरकार को इस मामले में हलफनामा दाखिल करने का निर्देश दिया है। सुशील त्रिवेदी की जनहित याचिका पर न्यायमूर्ति विक्रमनाथ और न्यायमूर्ति पंकज भाटिया की पीठ सुनवाई कर रही है। जनहित याचिका में कहा गया है कि बेसिक शिक्षा परिषद की ओर से संचालित प्राथमिक व जूनियर हाईस्कूलों के तमाम शिक्षकों को सरकारी कार्यालयों में संबद्ध किया गया है। इससे विद्यालयों में शिक्षकों के पद रिक्त हैं और शिक्षण कार्य प्रभावित हो रहा है। ऐसे शिक्षकों की संबद्धता समाप्त कर उनको स्कूलों में भेजे जाने की मांग की गई ताकि शिक्षण कार्य प्रभावित न हो।

Goel, learned Additional Chief Standing Counsel for the State-respondent Nos.1 and 2 and Sri Ashok Kumar, learned counsel representing respondent No.3-District Basic Education Officer, Banda. 

This petition has been filed under Article 226 of the Constitution framed as a Public Interest Litigation (PIL) praying for writ of mandamus commanding the respondents to ensure that Assistant Teachers of Primary Schools and Junior High Schools run by the U.P. Basic Education Board are not attached to Government Offices and instead they be allowed to continue to impart education in the Primary Schools and Junior High Schools where they are appointed. 

The submission is that on account of such attachments, number of schools are left without teachers and in other Institutions on account of lack of teachers classes are not held. 

Sri Manish Goel, learned Additional Advocate General upon instructions states that all such attachment orders have already been revoked and further that in future also attachment orders would not be issued and the teachers appointed in Primary Schools and Junior High Schools will continue to impart their duty as teachers only. 

Let such instructions be placed by way of an affidavit of the Principal Secretary/Secretary, Department of Basic Education within a period of two weeks. 

Put up this matter as a fresh case on 30th August, 2019.
