शिक्षक पद पर दोबारा आवेदन को दें एनओसी, इलाहाबाद उच्च न्यायालय ने कहा, बेसिक शिक्षा परिषद के सचिव आदेश का पालन करें या चार जुलाई को अवमानना में हों हाजिर

प्रयागराज :  इलाहाबाद हाईकोर्ट ने बेसिक शिक्षा परिषद के सचिव प्रताप सिंह बघेल को पहले से सहायक अध्यापक के पद पर कार्य कर रहे अभ्यर्थियों को दोबारा इसी पद पर आवेदन करने के लिए चयनित सभी अध्यापकों को एनओसी देने के आदेश का पालन सुनिश्चित करने अन्यथा चार जुलाई को अवमानना आरोप तय करने के लिए उपस्थित रहने का निर्देश दिया है।

यह आदेश न्यायमूर्ति रोहित रंजन अग्रवाल ने रोहित कुमार व अन्य की अवमानना याचिका पर अधिवक्ता मान बहादुर सिंह को सुनकर दिया है। एकल पीठ ने याचियों की याचिका स्वीकार करते हुए राज्य सरकार के चार दिसंबर 2020 के शासनादेश के पैरा पांच एक को असंवैधानिक, मनमानापूर्ण और अधिकार क्षेत्र से बाहर करार देते हुए रद्द कर दिया था। 

इस शासनादेश से राज्य सरकार ने उन अभ्यर्थियों को 69000 सहायक अध्यापक पद के लिए चयनित होने के लिए अनापत्ति प्रमाण पत्र देने से मना कर दिया था जो पहले से ही सहायक अध्यापक पद पर कार्यरत थे। साथ ही सहायक अध्यापक के पद पर कार्य कर रहे अभ्यर्थियों को दोबारा इसी पद पर आवेदन के लिए चयनित सभी अध्यापकों को एनओसी देने के आदेश दिया था। इस आदेश के विरुद्ध राज्य सरकार की अपील खारिज हो गई। इसके बावजूद एकल पीठ के आदेश का अनुपालन न होने पर अवमानना याचिका की गई। 

अपील पर सुनवाई के बाद खंडपीठ ने कहा कि पहले से सहायक अध्यापक के पद पर कार्य कर रहे अभ्यर्थियों को दोबारा इसी पद पर आवेदन करने और चयनित होने का अधिकार है। ऐसा करके अभ्यर्थी अपने अंक बढ़ा सकते हैं और अपनी पसंद के जिले में नियुक्ति पा सकते है। उन्हें इस अधिकार का उपयोग करने से रोका नहीं जा सकता है। एकल पीठ का भी कहना था कि पहले से सहायक अध्यापक के पद पर काम कर रहे अभ्यर्थियों को दोबारा उसी पद के लिए आवेदन करने पर कोई रोक नहीं है।

Heard Sri Man Bahadur Singh, learned counsel for the applicants and Smt. Archana Singh, learned counsel for opposite party no.1.

The applicants before this Court had earlier filed Writ-A No.988 of 2021 along with other bunch of connected writ petitions. The said writ petition was allowed on 29.10.2021 with the following direction:-

"22. Accordingly, the writ petition is allowed by passing the following orders:

(i.) Para 5(1) of the Government Order dated 4 December 2020 is declared arbitrary, unreasonable, discriminatory and exceeding the authority conferred under Act, 1972 and Rules, 1981.

(ii.) Respondents are directed to issue NOC to all the petitioners recommended by the Selection Committee.

(iii.) All those Petitioners prohibited, in view of the Government Order dated 4 December 2020, from participating in the counselling, shall appear for counselling on the date to be notified by the Board.

(iv.) Petitioners shall be given appointment and placement of district strictly in accordance with Rules, 1981.

(v.) This order shall apply to all the candidates who have not approached this court but are affected by the impugned Government Order.

(vi.) The afore-noted orders shall be complied by the respondents within four weeks from the date of supply of copy of this order.

No Cost. "

Against the said judgment of the writ Court, the State filed Special Appeal No.75 of 2022. The Basic Education Board also filed Special Appeal No.78 of 2022 along with other appeals. The appellate Bench heard the bunch of appeals and dismissed the same vide judgment dated 19.04.2022.

Today, when the case was taken up, Smt. Archana Singh, learned counsel appearing for opposite party no.1 submitted that some time may be granted so that the order of the special appellate Court may be assailed before the Supreme Court. She further contended that the State is not the party in the present contempt proceedings, while the Government Order dated 04.12.2020 had been struck down by the writ Court.

Sri Man Bahadur Singh, learned counsel appearing for the applicant submitted that despite the judgment of the writ Court and the appellate Court, no NOC has been issued in favour of the applicants, nor they had been permitted to join at the allocated districts.

This Court finds that once the Government Order of 04th December, 2020 was struck down by the writ Court having been affirmed by the appellate Court, no occasion arose for opposite party no.1 to not comply the order of the writ Court.

This Court finds that the opposite party no.1 is in contempt for not complying the order dated 29.10.2021.

List this matter on 04th July, 2022.

On the said date, opposite party no.1 shall remain present in the Court for framing of charges.

In case, the order of the writ Court is complied with, an affidavit would suffice.
