चयन प्रक्रिया में शामिल न होने वाले शिक्षकों को जबरदस्ती अंग्रेजी माध्यम विद्यालयों में भेजने को नीति विरुद्ध मानते हुए सम्बन्धित शिक्षकों के मूल विद्यालय में कार्य करते रहने सम्बन्धी मा0 उच्च न्यायालय का आदेश

In the facts and circumstances of the case, it would be
appropriate to permit respondent no. 2 to examine the grievance
of the present petitioners inasmuch as it is alleged that
petitioner nos. 1 to 5 although had applied for appointment to
the post of Assistant Teacher in English Medium School but
have not participated in the selection, while petitioner nos. 6 to
11 have not even applied. As per scheme framed by the
Secretary concerned, it is only those who have participated in
selection and have actually been selected, that they could be
posted as Assistant Teacher in English medium institution. 
According to the District Basic Education Officer, Mirzapur, in
the absence of teachers, the petitioners have been asked to teach
in the English medium institution. This stand does not appear to
be in consonance with the policy framed by the Secretary of
the Board. 
In the facts and circumstances, noticed above, it would be
appropriate to direct the respondent no. 2 to examine the
grievance of the petitioners, noticed above, and pass a reasoned order within a period of six weeks from the date of presentation
of certified copy of this order. Till a fresh order is passed by the
authority concerned, the petitioners would be allowed to
continue at their present place of posting.
