दूरस्थ माध्यम से दो वर्षीय बीएड वाले भी बनेंगे शिक्षक

इलाहाबाद। दूरस्थ माध्यम से दो वर्षीय बीएड करने वाले भी प्राइमरी स्कूल में 72,825 प्रशिक्षु शिक्षकों की भर्ती में शामिल होंगे। इंदिरा गांधी मुक्त विश्वविद्यालय (इग्नू) से बीएड करने वाले सत्य प्रकाश यादव व अन्य की ओर से दायर याचिका की सुनवाई के बाद हाईकोर्ट ने 30 जुलाई को फैसला दिया है कि एक वर्षीय और दो वर्षीय बीएड करने वालों को एक समान माना जाए।

दरअसल उत्तर प्रदेश में 13 नवंबर 2011 को पहली बार आयोजित शिक्षक पात्रता परीक्षा (टीईटी) में सिर्फ एक वर्षीय बीएड करने वालों को मौका दिया गया था। इसके खिलाफ दो वर्षीय बीएड डिग्रीधारकों ने याचिका की तो हाईकोर्ट के आदेश पर दो वर्षीय बीएड वालों को टीईटी में शामिल किया गया।

इसके बाद 3 जनवरी 2013 को मिठाई लाल व अन्य की ओर से दायर स्पेशल अपील का निपटारा करते हुए हाईकोर्ट ने दो वर्षीय बीएड वालों के पक्ष में फैसला सुनाया था। लेकिन 25 मार्च 2014 को सुप्रीम कोर्ट के आदेश पर 72,825 प्रशिक्षु शिक्षकों की भर्ती दोबारा शुरू होने के बावजूद दो वर्षीय वालों में संशय की स्थिति बनी हुई थी।

इस पर सत्य प्रकाश यादव व अन्य ने हाईकोर्ट की लखनऊ बेंच में याचिका दायर कर 72,825 प्रशिक्षु शिक्षकों की भर्ती में अवसर दिए जाने का दावा किया। इग्नू और राजर्षि टंडन मुक्त विश्वविद्यालय से दो वर्षीय बीएड करने वालों का तर्क है कि उनकी डिग्री राष्ट्रीय अध्यापक शिक्षा परिषद (एनसीटीई) से मान्य है।

इसके बावजूद 72,825 प्रशिक्षु शिक्षक भर्ती में स्थिति स्पष्ट नहीं है। इस पर जस्टिस सुधीर कुमार सक्सेना ने उत्तर प्रदेश सरकार और बेसिक शिक्षा विभाग को प्रशिक्षु शिक्षक भर्ती में एक व दो वर्षीय बीएड को एक समान मानते हुए कार्यवाही के निर्देश दिए हैं।

This writ petition has been filed with following reliefs:-

"(i) Issue a writ, order or direction in the nature of certiorari quashing the

advertisement dated 22.9.2011 so far it restricts the eligibility to the

candidates having one year B.Ed. degree.

(ii) Issue a writ, order or direction in the nature of mandamus commanding

the respondents to permit the petitioners to submit their application forms for

selection of Trainee teachers for primary schools of U.P. Basic Education

Board and reckon their marks obtained in the TET for their selection.

(iii) Issue any other writ, order or direction as may be deemed fit and proper

under the circumstances of the case and allow this humble petition."

It is submitted by Sri Nishant Shukla that petitioners who have passed B.Ed.

two year course be permitted to appear in the T.E.T. as respondents are

permitting only those candidates who have completed B.Ed. one year degree

course. Authorities of State Government are not permitting them to appear in

the T.E.T. who are having two year B.Ed. degree course nor they are

accepting their forms.

Sri Sharad Tewari appearing for Indira Gandhi National Open University

states that University has been awarding degree by distance mode. There is no

difference between 'face to face' and distance mode. Sri M.M.Asthana who is

representing NCTE states that there is no difference between one year and

two year degree course and candidates who have completed two year degree

course cannot be discriminated. They have placed an order passed by this

Court in Special Appeal No. 2296 of 2011, Mithai Lal & others v. State of

U.P. & others in which similar controversy has been settled. Relevant para is

being reproduced below:-

"So far as, the distinction between a normal classroom mode and distance

learning mode is concerned that controversy has also been laid to rest by the

decision of this Court in the case of Gyanendra Kumar Sharma and others vs.

State of U.P. and others being Special Appeal No. 1271 of 2007 decided on

03.10.2007. It has been laid down by this Court that there is no difference

between the two modes of acquiring the B.Ed. qualification.

In the circumstances, the appeal is finally allowed. The appellants result of

the T.E.T. Examination in which the appellants had appeared provisionally

would be declared and relevant mark-sheet/certificate issued forthwith,

treating the provisional appearance to be regular appearance."

No contrary view has been shown by the State Government.

Consequently, this writ petition is allowed. Respondents are directed to treat

both the B.Ed. degree course i.e. one year degree course and the degree

obtained by distance mode at par with necessary consequences.
