16448 पदों पर भर्ती मामले की शीघ्र सुनवाई का आदेश, बेसिक शिक्षा विभाग को किया आगाह - एक सप्ताह के भीतर जवाब दाखिल नहीं 25 हजार रुपये याचीगण को देना होगा हर्जाना

इलाहाबाद : प्राथमिक स्कूलों में 16448 सहायक अध्यापकों की भर्ती के मामले में लंबित याचिका पर हाईकोर्ट की खंडपीठ ने त्वरित सुनवाई करने का निर्देश दिया है। कोर्ट ने बेसिक शिक्षा विभाग को यह भी आगाह किया है कि यदि एक सप्ताह के भीतर जवाब दाखिल नहीं किया जाता है तो सचिव बेसिक शिक्षा परिषद को 25 हजार रुपये याचीगण को हर्जाना देना होगा।

राहुल श्रीवास्तव की विशेष अपील पर यह आदेश मुख्य न्यायमूर्ति दिलीप बी भोसले और न्यायमूर्ति यशवंत वर्मा की पीठ ने दिया। अपील में एकल न्यायपीठ के आदेश के चुनौती दी गई थी। याची के अधिवक्ता सीमांत सिंह ने बताया कि सचिव बेसिक शिक्षा परिषद ने एक आदेश जारी कर हापुड़, बागपत और जालौन के अभ्यर्थियों तथा बीएलएड और डीएलएड के अभ्यर्थियों को किसी भी जिले से आवेदन करने की छूट दी है जबकि अन्य जिलों के अभ्यर्थी उसी जिले से आवेदन कर सकते हैं जहां से उन्होंने प्रशिक्षण प्राप्त किया है। एकल न्यायपीठ ने इस मामले में बेसिक शिक्षा परिषद से जवाब मांगते हुए कहा था कि चयन प्रक्रिया जारी रहेगी मगर परिणाम याचिका के निर्णय पर निर्भर करेगा। इसे अपील में चुनौती देकर कहा गया कि याचीगण के अधिकार का हनन हो रहा है क्योंकि सचिव का आदेश अवैधानिक है।

This special appeal is against an interlocutory order dated 8.8.2016 passed by learned Single Judge, whereby he, instead of granting interim order as prayed, issued the following directions in the concluding paragraph of the impugned order: 

"In view of the large scale impact that may be caused upon adjudication of the aforesaid issues, in the meantime, it is hereby provided that though the appointment process, as initiated by circular/letter dated 25.06.2016, may continue but all the appointments made thereunder, shall be subject to the result of these writ petitions and further, all appointment letters that shall be issued in pursuance thereof, shall specifically disclose that the appointment is subject to the decision of these petitions."� 

In the writ petition, the appellants have challenged Clause 6 (Kha) of the Circular dated 25.6.2016 issued by the Secretary, Basic Shiksha Parishad, Uttar Pradesh and prayed for stay of the recruitment process which commenced with the notification dated 16.6.2016 for 16,448 posts of Assistant Teacher for Primary Schools run by the Basic Shiksha Parishad, Uttar Pradesh. 

We are informed that the selection/recruitment process is going on and thousands of candidates have applied for this post. Keeping that in view, we are not inclined to entertain the special appeal and grant any interim order as prayed. 

It appears that learned Single Judge had directed the respondents to file their counter affidavits and kept the writ petition today for hearing. 

Counsel for the appellants submits that till today, the respondents have not filed their counter affidavits and, therefore, learned Single Judge may not hear the writ petition today. 

Keeping that in view, we are satisfied that the following order shall meet the ends of justice: 

"The respondents, in particular, the State as well as the Basic Shiksha Parishad, Uttar Pradesh, shall file their affidavits, within a period of one week from today failing which, they shall pay costs of Rs.25,000/- (Rupees Twenty Five Thousand Only) to the appellants, within a week therefrom. We request learned Single Judge to hear the writ petition expeditiously. All contentions, on merits, are kept open." The Special Appeal stands disposed of accordingly.
