16448 भर्ती : विशेष श्रेणी के पदों पर सामान्य की हो नियुक्ति, योग्य अभ्यर्थी न मिओए से रिक्त रह गए हैं पद, हाईकोर्ट ने प्रदेश सरकार और बेसिक शिक्षा विभाग से किया जवाब तलब। 

इलाहाबाद। 16,448 सहायक अध्यापकों की भर्ती के मामले में विशेष कटेगरी (विकलांग, पूर्व सैनिक, स्वतंत्रता सेनानी आश्रित) के रिक्त रह गए पदों पर सामान्य वर्ग के अभ्यर्थियों की नियुक्ति को लेकर दाखिल याचिका पर हाईकोर्ट ने बेसिक शिक्षा विभाग और प्रदेश सरकार से जवाब मांगा है। आनंद पांडेय और अन्य की याचिका पर न्यायमूर्ति मनोज मिश्र सुनवाई कर रहे हैं। याची के अधिवक्ता ने बताया कि 16,448 पदों पर सहायक अध्यापकों की भर्ती के लिए 16 जून 16 को अधिसूचना जारी की गयी थी। नियुक्ति प्रक्त्रिया प्रारंभ होने के बाद दो चरण की काउंसिलिंग पूरी हो गयी जिसमें विशेष श्रेणी के अधिकांश पद रिक्त रह गए हैं।

 प्रदेश सरकार 7 अप्रैल 16 को अधिसूचना जारी कर विशेष श्रेणी के पदों को अगले वर्ष के लिए कैरी फारवर्ड करने का नियम समाप्त कर दिया है। अभी तक विशेष श्रेणी के रिक्त पदों को योग्य अभ्यर्थी न मिलने पर अगली भर्ती के लिए कैरी फारवर्ड कर दिया जाता था। चूंकि यह नियम 16448 पदों की अधिसूचना जारी होने से पूर्व समाप्त हो चुका है। इसलिए विशेष श्रेणी के रिक्त पदों पर सामान्य श्रेणी के अभ्यर्थियों को नियुक्ति दी जाए। कोर्ट ने इस प्रश्न पर प्रदेश सरकार से जवाब मांगा है।

The petitioners had applied for appointment on the post of Assistant Teacher, Primary School pursuant to the recruitment process initiated vide notification dated 16.6.2016 by which 16448 posts of Assistant Teachers in various Primary Schools spread across the State of Uttar Pradesh were notified. It is the case of the petitioners that they had participated in the 1st and 2nd round of counselling but could not succeed to get selected as the cut off merit was higher than their quality point marks. This petition has been filed for a direction upon the respondents to initiate another round of counselling by converting the vacant seats available under the quota for dependents of freedom fighter; physically handicapped; and Ex Servicemen category candidates for being filled by unreserved category candidates. 

In support of the above prayer, Sri Seemant Singh, who appeared for the petitioners, submitted that the quota for the above category candidates was provided by U.P. Public Services (Reserved for Physical Handicapped, Dependent of Freedom Fighter and Ex Servicemen) Act, 1993 and under the said Act by Section 3(5) it was provided that if suitable candidates under the aforesaid category are available, then the vacancies reserved for the said category, which remains unfilled, shall be carried forward for further two selection years, thereafter it shall be treated to be lapsed. It has been submitted that by Government notification dated 7.4.2016, U.P. Public Services (Reserved for Physical Handicapped, Dependent of Freedom Fighter and Ex Servicemen) Act, 1993 was amended by U.P. Act No. 12 of 2016 so much so that sub section (5) of section 3 of the said Act was omitted which means that if under a recruitment process, initiated after the notification of U.P. Act No. 12 of 2016, the vacancies remain unfilled by candidates falling under the said quota, it shall not be carried forward. 

It is accordingly the prayer of the petitioners that a 3rd round of counselling be initiated by converting the vacant post reserved for the aforementioned quota to be filled by unreserved category candidates. 

The matter requires consideration. 

Learned Standing Counsel has accepted notice on behalf of respondent no. 1; Sri A.K. Yadav has accepted notice on behalf of respondents 2 and 3; and Sri B.P. Singh has accepted notice on behalf of respondents 4 and 5. 

They pray for and are allowed four weeks time to file counter affidavit. Two weeks thereafter shall be for filing rejoinder affidavit.
