बेसिक शिक्षकों के अन्तर्जनपदीय तबादले पर जवाब-तलब, हाईकोर्ट ने सरकार और बेसिक शिक्षा परिषद से तीन वर्ष की अहर्ता पूरी न किये पर किये ट्रांसफर पर मांगा जवाब

इलाहाबाद : बेसिक शिक्षा परिषद के विद्यालयों में कार्यरत शिक्षकों के अंतर जिला तबादले में धांधली के आरोप में दाखिल याचिका पर हाईकोर्ट ने प्रदेश सरकार और बेसिक शिक्षा परिषद से जवाब मांगा है। कोर्ट ने पूछा है कि उन शिक्षकों का तबादला कैसे हो गया जिन्होंने एक जिले में तीन वर्ष की तैनाती की न्यूनतम अर्हता पूरा नहीं की है। कोर्ट ने ऐसे लगभग 75 स्थानान्तरित शिक्षकों को भी नोटिस जारी कर जवाब मांगा। शिक्षिका निधि और दर्जनों अन्य की ओर से दाखिल याचिकाओं पर न्यायमूर्ति मनोज कुमार गुप्ता सुनवाई कर रहे हैं। 

याची के अधिवक्ता ने बताया कि 23 जून, 2016 को अंतर जिला स्थानांतरण की नीति घोषित की गई। उसके मुताबिक एक जिले में कम से कम तीन वर्ष से तैनात शिक्षक ही आवेदन कर सकेंगे। आवेदन ऑनलाइन किया जाना था। यह भी शर्त थी कि शिक्षक गृह जिला सहित पांच वरीयता भी देंगे। याचीगण ने ऑनलाइन आवेदन किया, मगर उनका स्थानांतरण नहीं किया गया, जबकि ऐसे शिक्षकों का स्थानांतरण कर दिया गया जिन्होंने न तो तीन वर्ष की अर्हता पूरी की है और न ही ऑनलाइन आवेदन किया था। इसके बाद 19 दिसंबर, 2016 को एक शासनादेश जारी कर कहा गया कि उन्हीं शिक्षकों का स्थानांतरण होगा जिन्होंने ऑनलाइन आवेदन किया है। याचिका में कहा गया है कि स्थानांतरण नीति और शासनादेश दोनों का उल्लंघन किया गया है।

The transfer of the private respondents is sought to be challenged on the ground that they had not completed three years of service on the date they filed applications seeking transfer, yet they have been transferred. It is urged that the same is contrary to the stipulation in the policy issued by the Board on 23 June 2016. 

Learned standing counsel has accepted notice on behalf of respondents 1 and 2 and Sri A. K. Yadav on behalf of respondent no.3. 

Issue notice to the private respondents fixing a date in the week commencing 8 May 2017. 

Steps to be taken within a week by registered post. 

All the respondents are directed to file counter affidavit by the next date. 

In the counter affidavit that would be filed by the third respondent, it shall clearly be disclosed as to how the transfer, if any, has been permitted in respect of teachers who had not completed three years of service.
