The petitioners have applied under the Scheduled Caste category for appointment on the post of Assistant Teacher in primary school in district Allahabad pursuant to notification dated 16th June, 2016 by which 16448 posts of Assistant Teacher were notified. The case of the petitioners is that from the record it appears that there were five posts of Assistant Teacher reserved for the Scheduled Tribes category candidate and after completion of counselling process, still four posts, which were reserved for Scheduled Tribes category candidate, lie vacant on account of non-availability of Scheduled Tribes candidate. 

The case of the petitioners is that Section 3(3) of the U.P. Public Services (Reservation of Scheduled Caste, Scheduled Tribes, and Other Backward Caste) Act, 1994 provides "where a suitable candidate belonging to Scheduled Tribes or Scheduled Castes, as the case may be, is not available in a recruitment, either under sub section (1) or sub section (2), the vacancy reserved for him may be filled in such recruitment, from amongst the suitable candidates belonging to Scheduled Castes or Scheduled Tribes, as the case may be, and as soon as a vacancy earmarked in the losses referred to in sub section (5) for Scheduled Castes or Scheduled Tribes, as the case may be, arises such persons belonging to Scheduled Castes or Scheduled Tribes, as the case may be, shall be adjusted against such vacancy of his own category." According to the petitioners since Scheduled Tribes candidates are not available therefore four seats reserved for Scheduled Tribes candidates be offered to Scheduled Castes candidates for appointment by relying on Section 3 (3) of 1994 Act. 

The matter requires consideration. 

Learned Standing Counsel has accepted notice on behalf of respondents 1 and 2 and Sri A.K. Yadav has accepted notice on behalf of respondent no.3. They pray for and are allowed three weeks time to file counter affidavit. One week thereafter shall be for the petitioners to file rejoinder affidavit.
