The petitioners have all applied for appointment in district Meerut. Their grievance is that from the letter written by the Basic Shiksha Adhikari, Meerut addressed to the Secretary, Basic Shiksha Parishad, Allahabad it appears that there were already teachers appointed in excess of the vacancies available in primary schools therefore, notifying five seats for district Meerut was not called for and, in case, if those five posts had not been notified, then, as per Clause 6 (Kha) of the Circular governing the recruitment procedure, the petitioners could have applied in other district as first preference candidate. It is thus prayed that the notification to the extent it notifies five seats for district Meerut be quashed. In the alternative, it has been submitted that there are some vacancies in the district of Meerut which are being filled by transfer therefore, those vacancies could have been notified, which could have increased the chances of success for the petitioners in the recruitment process.
The matter requires consideration.
Learned Standing Counsel has accepted notice on behalf of the respondent nos.1 and 2; and Sri Shivam Yadav has accepted notice on behalf of the respondent nos.3 and 4. They pray for and are allowed four weeks time to file counter affidavit. Rejoinder affidavit, if any, may be filed within two weeks, thereafter.
List this petition after six weeks.
