खण्‍ड शिक्षा अधिकारियों के तबादले पर बीएसए के अधिकार पर रोक : उच्च न्यायालय के फैसले के आधार पर निदेशालय की रोक

आजकल कई जिलों में खण्ड शिक्षाधिकारियों और जिला बेसिक शिक्षा अधिकारियों में ब्लाक स्तर के स्थानान्तरण और सम्बद्धीकरण को लेकर ठनी हुई है ....... जिसके सापेक्ष कुछ खण्ड शिक्षा अधिकारियों ने  मा० हाईकोर्ट से लेकर शासन और उच्चाधिकारियों तक दौड़ लगाईं थी। जिसके फलस्वरूप उच्च न्यायालय ने योजित रिट याचिका संख्‍या 1673 / 2012 की खण्‍डपीड के आदेश दि0 11-12-2012 के द्वारा इस अधिकार पर बंदिश लगा दी है। इसी सब प्रकरण के कुछ पत्र और उच्च न्यायालय के आदेश हाथ लगे हैं जिसे आप सब के साथ बाँट रहा हूँ।

शिक्षा निदेशक, बेसिक, उ0प्र0 इलाहाबाद ने अपने पत्र संख्‍या निरीक्षण /6115/2012-13 दि0 31-12-2012 द्वारा यह निर्देश जारी किये गए है कि जनपद के खण्‍ड शिक्षा अधिकारियों के तबादले अथवा सम्‍बद्वीकरण अपने स्‍तर से कदापि न किये जाये तथा इस सम्‍बन्‍ध में वह अपनी संस्‍तुति निदेशालय में प्रेषित करें, उक्‍त का पालन कडाई से किया जायेगा।

आप अवगत ही है कि उप विद्यालय निरीक्षक / सहायक बेसिक शिक्षा अधिकारी को उच्‍चीकत करते हुए समूह 'ग' राजपत्रित खण्‍ड शिक्षा अधिकारी में परिवर्तित किया जा चुका है। उक्‍त आदेश मा0 उच्‍च न्‍यायालय लखनउ में योजित रिट याचिका संख्‍या 1673 / 2012 की खण्‍डपीड के आदेश दि0 11-12-2012 के अनुपालन में पारित किया गया है।

राजपत्रित अधिकारी होने के बावजूद बेसिक शिक्षा अधिकारी उनके कार्य क्षेत्र में परिवर्तन करते थे। इसी को लेकर बलरामपुर में तैनात खण्ड शिक्षा अधिकारी सिद्धनाथ त्रिपाठी ने उच्च न्यायालय का दरवाजा खटखटाया। न्यायालय ने 11 दिसंबर को दिए गए आदेश में बीएसए द्वारा खण्ड शिक्षा अधिकारियों के विकास खण्ड परिवर्तन को नियम विरुद्ध बताया। बेसिक शिक्षा निदेशक को प्रकरण में नया निर्णय लेने का आदेश दिया।

With the consent of the counsel for the parties, we proceed to decide the writ petition finally at the admission stage itself.

Heard learned counsel for the petitioner and learned Standing Counsel.

The grievance of the petitioner is that the petitioner has been transferred/adjusted by the Basic Shiksha Adhikari within his district inter alia on the ground that the post of Block Education Officer has been upgraded in the year 2011 and has been classified as Class-II post and as such it is only the Director who is the competent authority to pass order of transfer/adjustment.

Sri C.B. Singh, learned counsel for the opposite parties, who has accepted notice on behalf of opposite party Nos. 2 and 3 submits that the Basic Shiksha Adhikari has been delegated with the powers to make transfer/adjustment within the district vide Government Order dated 09.01.2006, copy of which has been produced for perusal before this Court. On perusal of the same, it reflects that the said Government Order has been enforced w.e.f., the date of issuance in the year 2006 and provides the cases of persons who have been classified or categorized upto class III post the power be exercised by B.S.A whereas, the post of Khand Vikas Adhikari has been classified and categorized to class II in the year 2011 and as such the benefit of the said Government Order loses its efficacy with regards to the post of Block Education Officer after the post being upgraded and as such the order of transfer/adjustment has been made by the Basic Shiksha Adhikari is without jurisdiction.

Accordingly, we allow the writ petition and quash the order dated 26.11.2012. However, it will be open to the competent authority to pass fresh order in accordance with law.
