कस्तूरबा विद्यालयों से पुरुषों को हटाने में हाईकोर्ट ने किया जवाब तलब

प्रयागराज : इलाहाबाद हाईकोर्ट ने कस्तूरबा गांधी बालिका विद्यालयों में टीचिंग एवं नॉन टीचिंग स्टाफ केवल महिलाएं होने और पुरुषों का अनुबंध न बढ़ाने के शासनादेश के खिलाफ दाखिल याचिकाओं पर राज्य परियोजना निदेशक से जवाब दाखिल करने को कहा है। 

कोर्ट ने इस मामले में पूर्व में पारित अंतरिम आदेश जारी रखते हुए मामले में अगली सुनवाई के लिए तीन जुलाई की तारीख लगाई है। यह आदेश मुख्य न्यायमूर्ति प्रीतिंकर दिवाकर एवं न्यायमूर्ति आशुतोष श्रीवास्तव की खंडपीठ ने फारूक अहमद व 30 अन्य की याचिका पर वरिष्ठ अधिवक्ता अशोक खरे एडवोकेट सिद्धार्थ खरे, सीनियर एडवोकेट अनूप त्रिवेदी एवं एडवोकेट अतुल कुमार शाही को सुनकर दिया है।

मामले के तथ्यों के अनुसार 20 अक्तूबर 2022 को केंद्र सरकार आदेश जारी किया कि कस्तूरबा गांधी बालिका विद्यालय में अब किसी पुरुष का अनुबंध नवीनीकरण नहीं किया जाएगा। इस आदेश के बाद उत्तर प्रदेश शासन ने गत 20 अप्रैल को और राज्य परियोजना निदेशक ने 25 अप्रैल 2023 को आदेश जारी किया, जिसमें कहा गया कि सभी टीचिंग व नॉन टीचिंग स्टाफ अब महिलाएं होंगी। 

किसी पुरुष का किसी भी पद पर नवीनीकरण नहीं किया। फारूक अहमद व अन्य ने इस आदेश को याचिका के माध्यम से चुनौती दी। कोर्ट ने सुनवाई करते हुए 36 अकाउंटेंट के पक्ष में स्थगनादेश पारित कर दिया। उसके बाद लगभग डेढ़ दर्जन ये याचिकाएं दाखिल हुईं। 

कहा गया कि कस्तूरबा गांधी बालिका विद्यालय में सभी पदों पर महिलाओं का चयन भेदभावपूर्व है। राज्य परियोजना निदेशक की ओर से कहा गया कि यह केंद्र व राज्य सरकार का नीतिगत निर्णय है। कोर्ट को हस्तक्षेप नहीं करना चाहिए।

2. This petition is listed along with several other petitions involving almost similar facts and questions of law. In one of the connected matter being Writ A No. 8496 of 2023, Heera Lal & 2 other vs. Union of India & two others, counter affidavit has been filed, whereas, in other cases counter affidavit is yet to be filed.

3. Shri Anoop Trivedi, learned counsel for the respondents, submits that he would file counter affidavits in all cases within two weeks.

4. List this case along with other connected cases in the week commencing 3rd July, 2023, as fixed earlier.

4. In the meanwhile, after receiving the counter affidavit, the petitioners may file rejoinder affidavit.

5. Interim order, passed in Writ A No. 8274 of 2023 to continue till the next date of listing.
