प्रयागराज  । एकेडमिक मेरिट के आधार पर 72825 प्रशिक्षु शिक्षक भर्ती के लिए आवेदन करने वाले अभ्यर्थी राजकुमार मिश्र को फीस के रूप में जमा 18500 रुपये वापस मिलेंगे। राजकुमार ने फीस वापसी के लिए हाईकोर्ट में याचिका की थी। हाईकोर्ट ने 26 जुलाई को इस मामले की सुनवाई के दौरान सचिव बेसिक शिक्षा परिषद प्रताप सिंह बघेल को दस दिन में फीस वापस करने को कहा था। साथ ही अगली सुनवाई आठ अगस्त को रखी थी। मंगलवार को सुनवाई से पहले सात अगस्त की तारीख में बेसिक शिक्षा परिषद के सचिव और वित्त नियंत्रक के हस्ताक्षर से भारतीय स्टेट बैंक सिविल लाइंस को अभ्यर्थी राजकुमार के खाते में आरटीजीएस के माध्यम से 18500 रुपये हस्तांतरित करने के लिए चेक भेजा गया है। गौरतलब है कि डेढ़ लाख से अधिक अभ्यर्थियों ने दिसंबर 2012 में आवेदन के रूप में 290 करोड़ रुपये शुल्क दिया था। 

अन्य अभ्यर्थी भी कर सकते हैं याचिका

हाईकोर्ट के आदेश पर अभ्यर्थी राजकुमार मिश्र को फीस के 18500 रुपये वापस मिलने के बाद अन्य अभ्यर्थियों को भी उम्मीद जगी है। इससे पहले डायट प्राचार्यों के नाम पर सचिव फीस वापसी में टालमटोल कर रहे थे। अब कोर्ट के आदेश पर सचिव को सीधे अभ्यर्थी के खाते में फीस वापस करने पड़े हैं। ऐसे में अन्य अभ्यर्थी भी इस मामले को आधार बनाते हुए कोर्ट में जा सकते हैं।

प्रयागराज : एकेडमिक मेरिट के आधार पर 72825 प्रशिक्षु शिक्षक भर्ती के लिए दिसंबर 2012 में आवेदन के रूप में 290 करोड़ (2.9 अरब) रुपये फीस देने वाले अभ्यर्थियों को एक दशक बाद फिर से अपनी रकम वापसी की उम्मीद जगी है।

इलाहाबाद हाईकोर्ट ने बीती 26 जुलाई को एक अभ्यर्थी राजकुमार मिश्र के मामले में सचिव बेसिक शिक्षा परिषद प्रताप सिंह बघेल को दस दिन में फीस वापस करने को कहा है।इस मामले की सुनवाई आठ अगस्त को होगी। इसी के साथ आवेदन करने वाले डेढ़ लाख से अधिक बेरोजगारों को फीस वापस मिलने की उम्मीद जगी है।

तत्कालीन बसपा सरकार ने 30 नवंबर 2011 को प्राथमिक स्कूलों में 72,825 प्रशिक्षु शिक्षक भर्ती टीईटी मेरिट से शुरू की थी लेकिन पात्रता परीक्षा में धांधली के आरोप लगने के बाद सपा सरकार ने प्रशिक्षु शिक्षक भर्ती टीईटी मेरिट की बजाय एकेडमिक रिकार्ड (शैक्षिक गुणांक) के आधार पर करने का निर्णय लिया। दिसंबर 2012 में विज्ञापन जारी किया गया था। जिलों में आवेदन के लिए 500-500 रुपये फीस ली गई। 

कई अभ्यर्थियों ने 75 जिलों से फॉर्म भरा जिसके एवज में 40 हजार रुपये खर्च करने पड़े। 25 से 30 हजार रुपये फीस के रूप में सरकार को दिए। फीस के रूप में सचिव के खाते में 2,89,98,54,400 रुपये जमा हुए थे। हालांकि सुप्रीम कोर्ट के आदेश पर टीईटी मेरिट के आधार पर भर्ती पूरी हुई। पैसे वापस नहीं हुए।

सचिव संबंधित अभ्यर्थी को फीस वापस करें

कई अभ्यर्थी रुपये वापसी के लिए हाईकोर्ट में याचिकाएं कर चुके हैं। सचिव नवंबर 2018 से डायट प्राचार्यों पर फीस वापसी टाल रहे हैं। लेकिन अब कोर्ट ने साफ कहा है कि राशि सचिव के खाते में जमा हुई थी इसलिए सचिव ही संबंधित अभ्यर्थी को वापस करें।

1. Heard learned counsel appearing for the petitioner and learned Standing Counsel appearing for Respondent No.1 as well as Ms. Archana Singh, learned counsel appearing for Respondent No.2.

2. This Court after hearing the parties counsels passed an order on 18.07.2023 in following terms :-

"1. Heard learned counsel for the petitioner and learned Standing Counsel appearing for the Respondent No.1 as well as Mr. Shresth Pratap Singh Advocate, holding brief of Smt. Archana Singh, learned counsel appearing for the Respondent No.2.

2. Learned counsel for the petitioner has submitted that the petitioner pursuant to advertisement published for selection and appointment of 72,825 Trainee Teachers submitted application forms to Respondent No.2 for consideration of his candidature in 37 districts.

3. Learned counsel for the petitioner has further submitted that the petitioner in respect of application submitted for each district has paid Rs. 500/- separately to Respondent No.2 and the total amount for all the 37 districts comes to Rs. 18500/-.

4. Since no exercise of selection could take place in respect of the selections of 72,825 Trainee Teachers and therefore, ultimately decision was taken to refund the fee which was taken from the candidates. The grievance of the petitioner is that now Respondent No.2 is asking the petitioner to go and take refund of his fee from all the 37 districts and therefore, learned counsel for the petitioner has submitted that the Respondent No.2 in fact is creating the conditions in which the petitioner is compelled to forgo his right to get refund of his application fee.

5. Prima facie, this Court finds that once the fee has been deposited for each district to Respondent No.2 directly then there is no occasion for the petitioner to visit individual districts for taking refund of his fee.

6. Let categorical instructions in the aforesaid regard be taken by the learned counsel appearing for the Respondent No.2.

7. List this matter on 26th July, 2023 as fresh."

3. Today when the matter is taken up, Smt. Archana Singh, on the basis of instructions has submitted that the payment will be made to the petitioner by Respondent No.2 within a period of ten days and for getting his payment petitioner will not be required to visit any office of the Principal D.I.E.T.

4. Let this matter be listed on 08.08.2023 as fresh.

5. Court expects that the payment shall be made within the aforesaid period of ten days.
