  • UP plans tribunal to tackle teachers' cases

The UP government might soon set up a separate tribunal for the basic, secondary and higher education departments on the lines of Central Administrative Tribunal, which tackles the service matters of the central government employees.

The state government has appointed secretary , secondary education, Jeetendra Kumar as the nodal officer to set up the tribunal in the current financial year after conducting a viability study.

हाई कोर्ट में लंबित मुकदमों के बोझ तले हांफ रहे शिक्षा से जुड़े महकमों के लिए यह राहत भरी खबर है। वहीं अपने सेवा संबंधी मामलों को लेकर वर्षों तक हाई कोर्ट के चक्कर काटने वाले सरकारी और सहायताप्राप्त शिक्षण संस्थाओं के शिक्षकों और शिक्षणोत्तर कर्मचारियों के लिए भी यह तसल्लीबख्श खबर है। शिक्षा विभाग के सेवा संबंधी मामलों को सीधे हाई कोर्ट में जाने से रोकने और उनकी सुनवाई के लिए राज्य सरकार प्रदेश में स्टेट एजुकेशन  ट्रिब्यूनल गठित करेगी।

The three education departments together have to deal with around 15,000 cases and most are pending with the high court. A website of the advocate general office -Court Cases Information System (COCIS) -shows the number of pending cases from secondary education department at 7,479, followed by 5,560 from basic education department and 1,781 from higher education department at the Lucknow bench of Allahabad high court alone.At Allahabad high court bench, 9,774 pending cases are from secondary education department, 7,818 from basic education department and 3,052    from higher education department.
Confirming the formation of a committee to initiate the process for setting up a tribunal for issues primarily related to service matters, Kumar said that most of the cases are related to personal and administrative management in the education departments and in the absence of any separate tribunal for education, the applicants move the high court.


The genesis of huge number of cases was mainly due to improper functioning of selection boards authorized to make appointments in governmentaided schools and colleges, Kumar said. He added that in such cases managers of these schools had made several illegal appointments. Most of these selection boards were not working properly before 2012, Kumar said.
