पुरानी पेंशन योजना के सम्बन्ध में उच्च न्यायालय का अंतरिम आदेश : बेसिक शिक्षा परिषद NEWS

5 दिसंबर को मा० उच्च न्यायालय का एक अंतरिम आदेश आया है जिसमे सरकार को तीन सप्ताह के अन्दर यह फैसला लेने का निर्देश किया गया है कि चूँकि सेवा के समय से अब तक इन्हें पेंशन का कोई विकल्प नहीं दिया गया तो इन्हें पुरानी पेंशन का लाभ क्यों ना दिया जाए? और यदि नहीं दिया जाए तो क्यों?  इसे ब्लॉग में साझा किया जा रहा है कि भविष्य में यह काम आवे ~ ब्लॉग एडमिन

Heard Sri Shailendra learned counsel for the petitioners who are 17 in number and claim to be Assistant Teachers in various primary vidyalayas. The petitioner is aggrieved by the order dated 09.09.2008 whereby the new Pension Scheme 2005 has been enforced as also the order dated 20.11.2008 wherein the District Basic Education Officer has required all the Assistant Teachers to submit their option for deduction of contribution under the new pension scheme.

According to learned Standing Counsel the old pension scheme provide for qualifying period of service whereas under the new pension scheme those who have completed 10 years of service can also opt for the new pension scheme. Learned counsel for the petitioners has submitted that the new pension scheme is optional whether it be for persons having completed the qualifying period of service or those having not completed the period under those rules and hence the petitioners cannot be compelled to adopt the new pension scheme and unless there is an option no deduction of contribution from their salary can be made under the new pension scheme. From the aforesaid submission of learned counsel for the petitioners and learned Standing Counsel it appears that the petitioners have disputed deduction of contribution from their monthly salary under the new pension scheme and they want to continue with the old pension scheme. Since there is no specific order with respect to the petitioners passed by the respondent authority for deduction of contribution under the new pension scheme the issue requires to be decided as per the option provided by the State to such Assistant Teachers of primary schools. 

In view of the aforesaid circumstances it would be appropriate that the District Basic Education Officer of the respective districts where the 17 petitioners are working may consider their grievance as indicated above and upon a representation being made by the petitioners clearly indicating their option for the new pension scheme or the old pension scheme the District Basic Education Officer shall take a decision in accordance with law in the said individual cases within a period of three weeks from the date a certified copy of this order along with a detailed representation is filed by the petitioners and the pension contribution be deducted from the salary of the petitioners in accordance with the said decision. The writ petition stands disposed of. No order is passed as to costs.

10 वर्ष पूरे होने पर भी नई पेंशन शुरू नहीं हुई इस लिए निर्देश है कि क्योंकि इन्होने सर्विस के समय इन्हें नई पेंशन का कोई विकल्प नहीं दिया गया था इसलिए इन्हें पुरानी पेंशन का लाभ दिया जाए और नहीं तो क्यों इसका फैसला लेने के निर्देश दिए गए हैं इसके लिए ३ सप्ताह का समय दिया गया है! ~ आशुतोष मिश्र
